Halliwells LLP v NES v Quinn Insurance Limited [2011] EWHC 947 (QB)

Francis Bacon and Joshua Munro have recently received Judgment in an important decision on professional indemnity coverage. Francis Bacon represented Quinn Insurance, and Joshua Munro represented their policy-holder, NES Solicitors.

Following trial, HHJ McCahill QC, sitting as a Deputy High Court Judge in the Chancery Division, upheld Quinn's decision to decline indemnity for NES's liability to Halliwells for breach of an undertaking to pay £1.5million. The court ruled that the policy did not cover NES's breach of undertaking because:

(a) NES had given the undertaking dishonestly;

(b) the undertaking was not given in a solicitorial capacity;

(c) the undertaking was given for NES's own benefit."
