TP (A Child) v Gwent Healthcare NHS Trust (2007)
Martin Spencer QC and Tejina Mangat successfully negotiated an out of court settlement totalling £4 million in damages at the end of April 2007. The case alleged that a baby girl had suffered a hypoxic-ishaemic brain injury during her birth owing to a negligent failure to monitor the CTG with a consequent delay in effecting delivery before damage ensued.
The resulting prognosis was that the now 14 year old girl would continue to require total care for the resulting medical problems sustained, particularly in terms of mobility and epilepsy, and would have a life expectancy of just 41 years. The claims were not contested.
