Fiduciary duties can arise “ad hoc” and without any express appointment, the Supreme Court has confirmed, in a decision which demonstrates a firm approach to the assessment of liability where a person deals with another’s property contrary to requirements of good faith.

The case provides important clarification on the court’s approach to assessing equitable compensation, emphasising justice and full compensation over rigid rules.
