Eva Ferguson analyses this controversial recent judgment which extended losses recoverable under the Fatal Accidents Act 1976 to professional deputyship fees for dependants lacking capacity, and valued future services dependency using full commercial costs. Much like the England world cup football team there is plenty to like about the decision (from a claimant point of view), but there are frailties which might be susceptible to a sharp counterattack (possibly providing some comfort for insurers and medical defence organisations).
