Simon Howarth KC represented the 12th Defendant in KVB v Jacob Hopkins McKenzie, in which the proper application of the decision of the Court of Appeal in Anderson v Sense, in relation to liability under s.39 FSMA, was considered. The judgment also considers other statutory consequences of dealings with and the alleged promotion of collective investment schemes.
