Thomas Mason appeared for the successful Appellant in Joseph Strain v Transunion International UK Limited.

HHJ Wood KC determined that: (1) the purpose of paragraph 4.2 of Practice Direction 6A and CPR 6.23(6) is to ensure that e-mail service is effective, (2) service of the notice of discontinuance in this case was effective and (3) the order striking out the case was set aside on the correct application of CPR 44.15(c). The result is that the notice of discontinuance was effectively served the day before trial and the Claimant’s QOCS protection is re-instated.
