Solicitors’ Professional Indemnity Insurance – When does one partner ‘condone’ the dishonest conduct of another partner?

The Commercial Court has today handed down judgment in Discovery Land v AXIS. The case discusses with what insurers need to show in order to prove that one partner in a solicitors' firm has "condoned" the fraudulent act or omission of another partner, in circumstances where claimants have brought a claim against the firm which arises out of the other partner's fraud. This is the first High Court decision on this important topic for 12 years, and the first ever in the Commercial Court.
